A sign in Rogoznica was reported to have promised boat trips without a licence. The law is clear for powerful motorboats — and renters also bear responsibility. Here is what you need to check before handover.
The story began with a report, not a concluded official case
On 20 August, Morski.hr reported an English-language sign displaying the promise ‘License not required’ at a boat rental operation in Rogoznica. The article was based on an anonymous reader's tip, photographs and a telephone conversation which the publication says it conducted. During that call, a trip only as far as the island of Smokvica was reportedly described as requiring no licence.
The operator, specific boat, engine power, any actual handover and any penalty have not been officially confirmed. Golden Beach therefore names no company and adopts none of the scandal rhetoric. The report is the starting point for a fact-check, not proof that a particular person rented a boat illegally.
A local cruising area does not replace a certificate of competence
Croatian regulations require a boat to be operated by a person with the appropriate qualification. The permitted navigation area may be restricted in the boat's documents. That does not create an invented zone in which the licensing requirement suddenly disappears.
Smokvica is neither a legal free pass nor a magical distance boundary. What matters is the flag, length, engine power, authorised navigation area, type of use and recognition of the specific certificate of competence.
The Category A rule is narrow: up to seven metres and 15 kW
For privately used boats or boats rented without a crew, Croatian Category A may suffice only if the vessel is no more than seven metres long, its engine power is no more than 15 kW and it is operated within the corresponding restricted navigation areas. Both technical limits must be met at the same time.
Above 15 kW, at least Category B is required, and the operator must then be at least 18 years old. An engine said to produce 150 hp would be far above that threshold at around 110 kW. The six metres and eight kilowatts stated in older versions of the rules are no longer the current standard.
The German Sportbootführerschein See is generally recognised
The Croatian transport ministry's current recognition list includes the German Sportbootführerschein See for private and bareboat-rented boats and yachts up to 18 metres in Croatia's internal waters and territorial sea. The Sportküstenschifferschein is also listed.
If VHF or GMDSS radio equipment is carried, a suitable radio certificate may additionally be required. Saying ‘I may operate this small boat without a licence in Germany’ is not enough: Croatia assesses the specific boat and recognises specific documents.
A proper handover involves more than keys and a fuel gauge
Charter rules require the operator to check the skipper's qualifications. They also require valid boat documents, inspection of equipment and gear, instruction in safe navigation, emergency procedures, distress contacts and weather information, as well as a signed handover report.
The certificate of competence, seaworthiness and liability documents, and the handover report must be carried on board, among other items. For day hire without accommodation, a proper invoice must also be carried. A verbal ‘it'll be fine’ does not replace this chain of documentation.
Renters cannot delegate away their own responsibility
In a bareboat charter, the renter must ensure that the boat is operated by a qualified and authorised person. Anyone who accepts a boat without a recognised certificate cannot safely rely on the claim that the rental operator allowed the trip.
If an offer explicitly says that no licence is required for a powerful motorboat, the handover should be stopped. The safe alternative is a suitably qualified member of the party, a professional skipper or another offer that matches the certificates available.
Six questions before signing for any rental boat
The points to clarify are: Which qualification applies to this exact boat and area? Is the foreign document recognised? Is a radio certificate required? Will the boat, liability and seaworthiness documents be provided? Is there an invoice and a handover report? Have the permitted number of people, area, equipment, weather limits and return time been explained?
Photographs of the hull, propeller and existing damage should also form part of the handover. They do not replace a qualification, but they can prevent later disputes. If an answer is unclear, have it clarified in writing before departure.
Inspections in the area are real; the specific report remains separate
On 20 August, the harbour master's office and its branch offices carried out targeted checks that also covered boat rental operations in the Šibenik area. The ministry reported 30 inspections, eight offences and fines totalling €4,580; several cases concerned speed or planing, while others involved technical matters and boat and crew documents.
These figures have not been attributed to any particular rental operator in Rogoznica. They show only that documents and rent-a-boat businesses are subject to official inspection. The Rogoznica branch of the Šibenik Harbour Master's Office is responsible locally; call 112 in an emergency.
